These Terms of Service ("Terms") govern your use of the SmartShop mobile application ("App") operated by TechSpark Development LLC ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Service Description

SmartShop is a grocery savings app that uses artificial intelligence to analyze photos of your kitchen inventory and compare them against your online shopping cart to detect duplicate items and help you avoid unnecessary purchases.

2. Account & Access

Access to SmartShop is tied to your device. No email or password is required. Your device is automatically registered when you first use the App. You are responsible for maintaining access to your device.

3. Free & Premium Plans

Free Plan: You receive 2 free scans total. After your free scans are used, you will need to upgrade to Premium to continue using the scan feature.

Premium Plan: Premium subscribers receive unlimited scans, full photo analysis, permanent scan history, and priority processing. Premium is available as a monthly ($4.99/month) or yearly ($39.99/year) subscription.

4. Subscriptions & Billing

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription in your device's Settings > Subscriptions.
• No refunds are provided for partial billing periods.
• Prices may change with notice. Price changes will not affect your current billing period.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or extract source code from the App
• Use automated systems to access the App excessively
• Upload content that is illegal, harmful, or infringes on others' rights
• Share your account or device access for the purpose of circumventing subscription limits

6. AI Analysis Disclaimer

SmartShop uses AI to analyze your kitchen photos and shopping cart. While we strive for accuracy, the AI analysis is provided "as is" and may not always be 100% accurate. We are not responsible for:

• Missed duplicates or false positives in item detection
• Inaccurate price estimates
• Purchasing decisions made based on our analysis

Always verify important items before completing your purchase.

7. Intellectual Property

The App, including its design, features, and content, is owned by TechSpark Development LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the App.

8. Limitation of Liability

To the maximum extent permitted by law, TechSpark Development LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost savings, lost profits, or data loss, arising from your use of the App.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state where TechSpark Development LLC is registered.
